You have the right to withdraw from this contract within fourteen days without giving a reason. For goods, the period starts when you or a third party you nominate, other than the carrier, takes physical possession. For multiple goods under a single order delivered separately or in instalments, the legally relevant receipt of the last good or instalment applies. You may also declare withdrawal before receiving the goods. Failure to provide required information may extend the period under law.
How to exercise withdrawal
Notify Smartquot e.U. through an unequivocal declaration, for example by email, post or the “Withdraw from contract” function available without login. You may use the model form below but are not required to do so. The electronic function displays your details before final confirmation and emails an acknowledgement containing the declaration, date and time. Sending the declaration in time is sufficient; prior approval or a reason is not required.
Refund following withdrawal
For a valid withdrawal, we reimburse all payments received, including the least expensive standard delivery offered, without undue delay and no later than fourteen days after receiving your declaration. Additional costs of a more expensive delivery option you chose are not reimbursed. We use the same payment method unless expressly agreed otherwise, without reimbursement fees for you. For dispatched goods, we may withhold reimbursement until goods are received back or proof of return is supplied, whichever is earlier, unless we offered collection.
Returning goods and costs
Return the goods to the return address below without undue delay and within fourteen days after declaring withdrawal. Sending them before the deadline is sufficient. You bear direct return costs for voluntary withdrawal where properly informed of that obligation. For goods that cannot normally be returned by post, actual return costs must be disclosed before ordering. Defective goods are subject to separate statutory remedies free of charge, for which the seller is responsible.
Handling the goods
You are liable for diminished value only where it results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, and statutory information requirements are met. No flat restocking fee or unopened original packaging is made a condition of withdrawal here.
Personalised goods: no blanket exception
A statutory exception may apply, in particular, to goods made to the individual buyer’s specifications or clearly personalised for their needs. A limited community design, preorder, production after campaign end or standard size choice does not automatically suffice. Any exception must be assessed per product and clearly disclosed before contracting. Statutory rights for defects remain even where withdrawal is validly excluded.
