The seller and recipient of customer payments is Smartquot e.U.. Drokie is the brand used. Under this model, creators do not sell goods to buyers. The seller coordinates manufacture and delivery itself or through appointed partners and remains responsible for its statutory contractual duties.
Scope and information
These terms concern purchases of goods through the platform. Before ordering, review the product, variants, pack quantity, total price, currency, delivery country, shipping cost, campaign deadline and delivery information. General statements do not replace campaign-specific details. Mandatory consumer rights apply independently of these terms.
Drops and preorders
A drop groups preorders for a product developed with a creator. Payment is collected when ordering, not only once the production target is met. The target counts valid paid units after cancellations and refunds. Payments are reconciled after the deadline. If the required target is missed or the campaign is cancelled, the full amount charged, including shipping and collected taxes, is refunded. Reaching the target does not remove withdrawal or conformity rights.
Ordering and contract formation
Selection on the product page leads to hosted Stripe Checkout, where details can be reviewed and corrected before binding payment. The preorder contract with the seller is formed when successful payment is confirmed, with the stated refund if the campaign fails. Returning to the success page alone does not prove payment; server-verified payment confirmation is decisive. Order confirmation is sent by email. Guest ordering is available, and secure order access does not impose an account requirement for statutory declarations.
Prices, currency and payment
Each drop has one currency. For new campaigns prepared through the simplified flow, the published pack price includes delivery to the authorised countries; no additional shipping charge is added at checkout. Smartquot e.U. has declared VAT exemption under the applicable small-business scheme; this is not a zero VAT rate. Availability and the applicable tax treatment must be confirmed for each destination before it is enabled. The binding total is shown before payment. Historical orders retain their agreed conditions. Any additional import charges and who bears them must be determined and disclosed before offering an affected destination; no DDP or DAP arrangement is assumed.
Production and delivery
Production depends on successful completion of the campaign’s preorder phase. Preordering does not mean stock is immediately available. The specific delivery window or agreed date must be shown before ordering. Statutory rules on delay, termination and passing of risk continue to apply; an estimate does not permit unlimited delay. Withdrawal and refunds
Consumers may exercise any statutory withdrawal right under the withdrawal policy. A series produced for a community, production after ordering, or selection of a standard variant does not automatically exclude that right. Any exception for goods made to the individual buyer’s specifications must be assessed specifically and disclosed before contracting. Electronic withdrawal is available without login; email and post remain available.
Legal conformity guarantee and product safety
Statutory conformity rights, including Austrian VGG and KSchG, and applicable product safety rules apply. New movable goods generally have at least two years of legal guarantee from delivery; any longer applicable national rights remain. Depending on statutory conditions, remedies include free repair or replacement and, where applicable, price reduction or contract termination. A voluntary manufacturer guarantee does not replace these rights. Manufacturer and safety information, any required EU responsible person and product warnings must be checked and provided before each product is offered live. Creators and their content
A verified account may submit an original campaign idea, desired duration, indicative price including shipping, quantity and optional private reference images. These preferences are not the final sales conditions or a guarantee of acceptance. Drokie reviews the idea, prepares one final product and its public presentation in German, English and Spanish, and confirms the commercial conditions. The creator must accept the current final revision before administrative publication. Changes invalidate earlier acceptance. Creators must hold the necessary rights to submitted material. Agreed compensation is recorded per unit and currency; estimated compensation is not a paid settlement. Specific licences, production arrangements, compensation and cancellation terms must be agreed before publication.
Responsibility and liability
The seller remains responsible to buyers for performance even when appointing production or shipping partners. Stripe provides payment services and does not certify product safety or contractual performance. Statutory liability, particularly for personal injury, intentional or grossly negligent conduct and mandatory product liability, is not excluded here. Mandatory consumer protections are not restricted.
Law and language
Austrian law applies to the extent a valid choice of law is permitted. Consumers do not thereby lose mandatory protection in their country of habitual residence. Statutory consumer jurisdiction remains unaffected; no exclusive Linz forum is imposed. German is the legal reference version; translations and the language used in contracting must not reduce mandatory rights.
